1. Introduction

1. 1. In these Terms and Conditions, the following words have these meanings, unless the context otherwise requires:
   1. “Travel Credits Voucher” means a Travel Credits Voucher provided by TLC Worldwide Travel Ltd - 54 Baker Street, London, W1U 7BU. Company Registration Number 13047019 (England).
   2. “Eligible Energy Plan” means an energy account established through the BeMoved platform that remains connected with the chosen Energy Retailer for at least 30 days from the requested date.
   3. “Short Terms and Conditions” as defined on the correspondence or material which links to these Terms and Conditions.
2. The promoter is BeMoved Pty Ltd (ABN 37 649 325 940), of Level 8, 2 Bligh Street, Sydney NSW 2000 (Promoter).
3. Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
4. Subject to these Terms and Conditions the Promoter is offering eligible participants a Hotel Gift Voucher when they switch to an Eligible Energy Plan through the BeMoved platform. An Eligible Energy Plan as set out under the heading “Eligibility and Participation” in clause 7 of these Terms and Conditions (Promotion). 
5. For the avoidance of doubt, this Promotion is only open to customers taking up a new Eligible Energy Plan through the BeMoved platform, https://www.bemoved.com.au/utilities/expedia-offer .
6. The Promotion will commence at 12.01am (AEST) on 29 April 2025 and will end at 11.59pm (AEST) on 30 June 2025 (Promotion Period). Participants are ineligible to participate if they enter after the Promotion Period.
7. Entry into the Promotion and any offer of an Eligible Energy Plan is subject to the applicable Energy Retailer’s terms and conditions.

2. Eligibility and Participation

1. In order to be eligible for the Hotel Gift Voucher, the customer must meet all of the following criteria (Eligible Participant):
   1. Be an Australian resident aged 18 or over at time of entry;
   2. Establish a new Eligible Energy Plan (Eligible Energy Plan) online via https://www.bemoved.com.au/utilities/expedia-offer during the Promotion Period.
   3. Not be an officer or employee of the Promoter, its related bodies corporate, or their immediate family;
   4. Not be an officer or employee of any agents or service providers of the Promoter directly associated with the conduct of the Promotion, or their immediate family; and
   5. Provide a valid email address.
2. For the avoidance of doubt, customers who take up a new Eligible Energy Plan via third party affiliate platforms are ineligible to participate.
3. Eligible Participants will receive one (1) Hotel Gift Voucher for each Eligible Energy Plan that is established during the Promotion Period in accordance with clause 1.6.
4. Eligible Participants will receive an email once their energy plan has been determined to be eligible.The email is sent to the Participant via the email address associated with the Eligible Energy Plan. The email includes a username and password (Login Credentials). Eligible Participants are able to use their Login Credentials on TLC’s website to access their Hotel Gift Voucher and make a hotel booking.
5. Eligible Participants must obtain their Login Credentials within 3 months of receiving the email. Eligible Participants must use the Hotel Gift Voucher before the expiry date shown on the Gift Voucher.
6. If an Eligible Participant does not obtain their Login Credentials within 3 months of receiving the email as set out in clause 2.4 above, or if they fail to use the Gift Voucher within the stipulated expiry date, the Hotel Gift Voucher will be forfeited, and cash will not be awarded in lieu.

3. Privacy

1. The Promoter is committed to protecting Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website https://www.bemoved.com.au. It contains information about how participants can complain about a breach of the Australian Privacy Principles and further details of how the Promoter will collect, store, use and disclose Personal Information can be found there. Participants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at contact@bemoved.com.au. In these Terms and Conditions, Personal Information has the meaning given to it in the Privacy Act 1988 (Cth).
2. Personal Information is collected in connection with entry into this Promotion for the purpose of facilitating access to the Hotel Gift Voucher. If the Personal Information requested is not provided, then a person will be ineligible to participate in this Promotion. By entering into the Promotion, the participant consents to the Promoter disclosing the Personal Information to TLC and to any of the Promoter’s related entities, using the Personal Information to process and validate the customer’s claim for the Hotel Gift Voucher, and to arrange delivery to the customer (if eligible). The Promoter may use or disclose the participants’ personal information for marketing or promotional purposes in relation to this Promotion.
3. By entering the Promotion, participants acknowledge that a further primary purpose for the collection of the participant’s Personal Information is to contact the participant in the future with information about the Promoter or the Retailer, including special offers, market research or to provide marketing materials via any medium including mail or any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.
4. The Promoter will never sell a participant’s Personal Information to other companies, however, the Promoter may share an entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties, some of which are located in the countries listed in the Promoter’s Privacy Policy, who may contact the participant for their legitimate commercial purposes. Some of these parties may be located outside of Australia, including but not limited to India, Philippines, Singapore, South Africa, United Kingdom, Canada, Israel, and the United States of America and entrants understand and acknowledge that Australian Privacy Principal 8.1 will not apply to such disclosures of their personal information. By entering the Promotion, participants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.

4. General

1. This Promotion is not available in conjunction with any other promotion or offer.
2. The Promoter reserves the right to disqualify any person from receiving the Hotel Gift Voucher if any of the following occurs:
   1. If it suspects fraudulent activity; or
   2. for a breach of these Terms and Conditions; or
   3. if it decides the person has not acted in good faith; or
   4. for any false or misleading conduct of any kind.
3. The redemption website is operated and hosted by TLC Worldwide Travel Ltd (TLC). The Promoter is not responsible for, or liable in respect of, products and services provided by TLC.
4. Terms and Conditions of the individual Hotel Gift Voucher will be included in the voucher redemption email and/or be made available on TLC’s website. Eligible Participants must check their Hotel Gift Voucher for usage instructions, terms and conditions, and expiry date.
5. Use of the Hotel Gift Voucher is also subject to additional terms and conditions of TLC located here: https://en-au.travelcredits.com/terms-and-conditions/ including any applicable booking or seasonal availability and block-out periods.
6. The Hotel Gift Voucher is not refundable, reloadable, transferable or exchangeable and cannot be taken as cash, in whole or part thereof. Expired Hotel Gift Vouchers cannot be extended or replaced. If a Hotel Gift Voucher or receipt of it incurs a tax liability, the relevant recipient of the Hotel Gift Voucher is liable for payment of such tax.
7. All other costs and expenses associated with the Hotel Gift Voucher (including, but not limited to, the costs of transport to and from the hotel, meals and other travel related expenses) will be at the Eligible Participant’s cost. The Promoter will not be liable for the failure of the Eligible Participant and their companion to meet schedules or cancellations for whatever reason and regardless as to fault, and no cash or alternative tickets or bookings will be awarded in lieu of that element of the voucher.
8. The Promoter reserves the right in its sole discretion, and to the extent permitted by law, or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at any time without notice. The Terms and Conditions may be varied at any time without notice unless to do so would be prohibited by law.
9. If the offer of the Hotel Gift Voucher is withdrawn or the Promotion terminated by the Promoter, the Eligible Participant will only be eligible for the Hotel Gift Voucher after the withdrawal or termination date if the offer was applied to the new Eligible Energy Plan while the offer was still in market and the Promotion active.
10. The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate) within the cooling off period. If the Eligible Participant fails to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, the Eligible Participant will not be eligible for the Hotel Gift Voucher.
11. Any costs associated with accessing the Promotion’s URL or the cost of calling the Promoter in the take up of a new Eligible Energy Plan is the customer’s responsibility and is depending on the Internet or telephone service provider used.
12. If there is a dispute regarding the conduct of the Promotion, participants agree that the decision of the Promoter will be final, and no further correspondence will be entered into.
13. The Promoter and/or Retailer (including its officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Hotel Gift Voucher (whether negligent or not), except for any liability that cannot be excluded by law.
14. The Promoter reserves the right to withdraw or substitute the Hotel Gift Voucher with another offer of equal or greater value at the Promoter’s discretion.
